Superior Garden & Lawns respects the privacy of our customers, prospective customers, suppliers, workers and other people who interact with our business.

This Privacy Policy explains how we collect, hold, use and disclose personal information and how you can access or correct your information or raise a privacy concern.

We aim to handle personal information responsibly and transparently and, where applicable, in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

Even where particular provisions of the Privacy Act may not apply to us, we aim to follow these principles as a practical standard for handling personal information.

1. Personal information we may collect

Depending on your dealings with us, we may collect information including:

  • your name;

  • telephone number and email address;

  • residential, service and billing addresses;

  • information about the property where services are requested or performed;

  • details of enquiries, inspections, quotes, bookings and services;

  • correspondence by telephone, SMS, email, website, social media or other communication channels;

  • photographs or video of a property, garden, work area, site condition or completed work;

  • invoices, transaction and payment information;

  • records relating to complaints, insurance matters, incidents or disputes;

  • information supplied by property managers, owners corporations, support coordinators, plan managers, government agencies or other authorised representatives;

  • information reasonably required to administer NDIS, DVA, WorkCover or other funded or third-party arranged services;

  • website and technical information such as IP address, browser type, device information, referring pages and website usage data; and

  • other information reasonably necessary to provide our services or operate our business.

2. Sensitive and health information

We do not generally require detailed medical or health information to provide gardening, lawn or property-maintenance services.

However, in some circumstances we may receive limited sensitive or health-related information, particularly where services are arranged through the NDIS, DVA, WorkCover, a support coordinator, plan manager, family member or other authorised representative.

We will seek to collect only the information reasonably necessary to safely provide the requested service, understand relevant access or communication requirements, administer or substantiate funded services, comply with applicable obligations, or manage a safety, insurance or legal issue.

We do not require customers to provide detailed diagnoses or medical histories unless that information is genuinely necessary for a particular purpose.

Where sensitive information is collected, we will handle it with additional care and only use or disclose it where permitted or authorised.

3. How we collect personal information

We may collect personal information directly from you, through website forms, phone, SMS, email, social media, property inspections, our quoting and business-management systems, authorised representatives, or organisations involved in arranging or funding services.

Where practical, we will collect personal information directly from the person concerned.

4. Anonymous and pseudonymous enquiries

Where practical, you may make a general enquiry without providing your full identity.

However, we will normally require sufficient identifying and contact information to inspect a property, provide a property-specific quote, manage a booking, provide services, issue an invoice, administer funded services or meet safety and legal obligations.

5. Why we collect and use personal information

We may collect, hold, use and disclose personal information to respond to enquiries, inspect properties, prepare quotes, schedule and provide services, communicate with customers, manage recurring services, issue invoices and receipts, process payments, administer funded services, maintain records, document site conditions, manage safety or disputes, improve our services, operate our website, send service communications, send lawful marketing communications and comply with accounting, taxation, insurance and other legal obligations.

We will not use or disclose personal information for an unrelated purpose where doing so would be inappropriate or unlawful.

6. Photographs and video

We may take photographs or video for legitimate operational purposes including quoting, documenting site conditions, identifying hazards, recording existing damage, quality control, recording completed work, maintaining business records and assisting with complaints, insurance matters or disputes.

Promotional use

We may use photographs of completed work for our website, social media, advertising, portfolio or promotional material without obtaining prior approval where the material does not show an identifiable person and does not contain details that would reasonably identify the customer or property to the general public.

Before promotional use, we will take reasonable steps to avoid, crop, obscure or remove obvious identifying information such as:

  • street addresses;

  • house numbers;

  • street signs;

  • vehicle registration numbers;

  • visible documents or personal information;

  • identifiable people; and

  • location metadata where relevant.

We will not accompany such material with text that identifies the customer or property.

A customer may still recognise their own garden or property even where it is not reasonably identifiable to the general public.

We will obtain permission before using photographs or video for promotional purposes where they show an identifiable person or are otherwise reasonably capable of identifying the customer or property.

Customers may ask us at any time not to use photographs of their property for future promotional purposes. Where reasonably practicable, we will also remove previously published material from channels under our direct control after receiving such a request. This may not be possible for material already printed, distributed, independently republished or otherwise outside our control.

This section should be read together with the photograph and promotional-use provisions in our Terms of Service.

7. Website, cookies and analytics

Our website may use cookies, analytics services and similar technologies to understand how visitors use the website, maintain website functionality and improve its performance.

Information collected may include pages viewed, approximate geographic location derived from technical information, browser and device type, referring website, time and date of visits, website interactions and IP address or similar technical identifiers.

We may use third-party analytics services, including Google Analytics.

You can generally control or disable cookies through your browser settings. Disabling certain cookies may affect some website functions.

8. Payments

Payments may be processed through banks, card processors or other authorised payment providers.

Where a third-party payment provider processes a transaction, that provider may collect and process payment information under its own terms and privacy policy.

Superior Garden & Lawns does not normally receive or store complete debit or credit card numbers.

We may retain transaction information reasonably required for invoicing, accounting and taxation, refunds, payment reconciliation, dispute management and lawful business records.

9. Disclosure to other parties

We may disclose personal information where reasonably necessary to employees, workers, contractors, accountants, bookkeepers, job-management providers, invoicing platforms, banks, payment processors, website or technology providers, insurers, professional advisers, property managers, owners corporations, support coordinators, plan managers, DVA, WorkCover, government authorities or other service providers involved in operating the business or delivering services.

We do not sell, rent or trade customer personal information for third-party marketing.

10. Third-party systems and overseas recipients

Some technology and service providers used by Superior Garden & Lawns may operate systems or engage service providers located outside Australia.

Depending on the provider, information may be stored, accessed or processed in countries including the United States and other locations used by the relevant cloud or technology provider.

The locations used by technology providers may change from time to time.

Where applicable privacy law requires it, we will take reasonable steps before disclosing personal information to an overseas recipient.

Third-party providers may also handle information according to their own privacy policies and contractual arrangements.

11. Security of personal information

We take reasonable steps appropriate to the size and nature of our business to protect personal information against misuse, interference, loss, unauthorised access, unauthorised modification and unauthorised disclosure.

Measures may include password-protected accounts and devices, access controls, reputable cloud systems, device and software security, restricted staff access and secure disposal practices.

No electronic transmission or storage system can be guaranteed to be completely secure.

12. Data breaches

If we become aware of a suspected loss, unauthorised access or disclosure of personal information, we will take reasonable steps to contain the incident, investigate what occurred, reduce the risk of further harm and take appropriate remedial action.

Where the Notifiable Data Breaches scheme or another applicable law requires notification, we will notify affected individuals and the relevant regulator as required.

13. Retaining information

We retain personal information for as long as reasonably necessary for the purpose for which it was collected or for legitimate business, contractual, accounting, taxation, insurance or legal requirements.

When personal information is no longer reasonably required and there is no lawful reason to retain it, we will take reasonable steps to securely destroy or de-identify it where practicable.

14. Direct marketing

We may send marketing communications about Superior Garden & Lawns services, seasonal services, business updates or offers where permitted by law.

For commercial electronic messages such as marketing emails or SMS messages, we will identify ourselves, provide appropriate contact details and provide a clear and functional way to unsubscribe.

You may withdraw your consent to marketing at any time.

Service-related messages about an existing enquiry, quote, booking, account, invoice or job may still be sent where reasonably necessary to manage the service.

15. Accessing and correcting your information

You may contact us to ask what personal information we hold about you, request access, request correction of inaccurate or outdated information, or raise a concern about how your information has been handled.

We may need to verify your identity before providing access or making changes.

We may refuse or limit access in circumstances permitted or required by law.

16. Privacy complaints

If you believe we have mishandled your personal information, please contact us first using the details below.

We will assess the issue, make reasonable enquiries where necessary and aim to respond within a reasonable period.

Where the Privacy Act applies, you may also have the right to complain to the Office of the Australian Information Commissioner (OAIC) if you are not satisfied with our response.

17. Information about other people

If you provide us with personal information about another person, you should only do so where you are authorised to provide the information, it is reasonably necessary for arranging or administering services, or the disclosure is otherwise lawful.

Where reasonably practicable, you should make that person aware that their information has been provided to us.

18. Third-party websites and platforms

Our website, emails or social media pages may contain links to websites, payment services or platforms operated by other organisations.

Superior Garden & Lawns does not control the privacy practices of unrelated third parties.

We encourage you to review the privacy policy of those organisations before providing personal information directly to them.

19. Changes to this Privacy Policy

We may update this Privacy Policy from time to time to reflect changes to our business, technology, service providers, operational practices or legal and regulatory requirements.

The current version will be made available on our website.

The effective date shown at the beginning identifies the current version.
